Terms and Conditions for Professional Photography and Videography Requests – Canicross World Championship
1. Definitions
For the purposes of these Terms and Conditions:
Event means the Canicross World Championship organized under the authority of the International Canicross Federation (ICF).
ICF means the International Canicross Federation.
Local Federation means the national federation affiliated with the ICF responsible for the Event.
Creator means the photographer or videographer who creates photographic or audiovisual works during the Event.
Material means any photographic or audiovisual work created during the Event.
Commercial Use means any use intended to generate direct or indirect economic benefit, including but not limited to sale, licensing, advertising, sponsorship, or monetized online content.
2. Scope and Validity of Permission
Permission to carry out professional photography and videography is granted exclusively for the Event, subject to prior written approval by the ICF.
Such permission:
- is event-specific,
- is valid solely for the official duration of the Event,
- does not constitute a general or recurring authorization,
- does not extend to future events or other competitions organized by the ICF or Local Federations.
The ICF reserves the right to revoke permission in the event of a material breach of these Terms.
3. Copyright and Authorship
The Creator shall remain the sole author and copyright holder of the Material in accordance with applicable copyright laws.
Nothing in these Terms shall be construed as a transfer or assignment of copyright.
4. Grant of Rights to the ICF and Local Federation
By submitting a request and receiving permission, the Creator grants the ICF and the Local Federation a non-exclusive, worldwide, royalty-free, irrevocable license to use the Material for:
- event-related promotion,
- marketing and communication activities,
- editorial publications,
- archival and historical documentation,
- publication on websites, social media, and digital platforms,
- use in press releases, newsletters, and presentations,
- reproduction, distribution, public display, and communication of the Material in any media or format,
- adaptation or technical processing of the Material, where necessary, solely for formatting and presentation purposes, without altering its essential content.
This license includes the right to use the Material both independently and in combination with other audiovisual or written content and applies to all current and future media and technologies.
This license is granted without limitation in time and applies to all current and future media.
Where reasonably practicable, the ICF shall credit the Creator.
5. Use of the Material by the Creator
The Creator retains the right to use the Material exclusively for self-promotional purposes, including, but not limited to, portfolios, personal websites, professional profiles, and social media accounts. The Creator is also granted limited commercial rights to sell photographs and videos solely to athletes, national federations of member countries affiliated with the ICF, and media organizations.
Such use is permitted under the following conditions:
- It does not imply any form of official partnership, endorsement, or support, whether direct or indirect, by the ICF or the local Federation.
- It does not harm the reputation, image, or legitimate interests of the ICF, the local Federation, or the event.
- It does not conflict with any existing or future commercial agreements, sponsorships, or exploitation rights of the ICF or the local Federation.
- It is accompanied, whenever reasonably possible, by an appropriate and non-misleading reference to the event and/or the ICF.
Any other form of commercial use of the Material by the Creator, beyond the limited circumstances described above, is strictly prohibited, including, but not limited to, sale, licensing, distribution through agencies, use in advertising campaigns, or monetized content, without the prior explicit written consent of the ICF.
Any publication or incorporation of the Material by the Creator must be declared through the designated form available on the ICF website, accessible via the “MEDIA” button in the website footer.
The ICF reserves the right to require the immediate removal of, or cessation of use of, any Material if it reasonably determines that these Terms have been violated or that its interests have been adversely affected.
6. Third-Party Rights and Image Rights
The Creator acknowledges that the Material may include images of identifiable individuals, trademarks, or other protected elements and undertakes to fully comply with all applicable laws and regulations concerning:
- image and personality rights,
- personal data protection (including the General Data Protection Regulation – GDPR),
- third-party intellectual and industrial property rights.
The Creator bears sole responsibility for obtaining any required permissions, approvals, or consents for the use of the Material in cases that exceed the use permitted under these Terms.
For the avoidance of doubt:
- the ICF and the Local Federation are responsible for obtaining the necessary consents from participants for their own use of the Material in the context of the Event,
- the Creator shall indemnify and hold harmless the ICF and the Local Federation from and against any third-party claims arising from unauthorized or unlawful use of the Material by the Creator.
7. Use of Logos and Trademarks
The Creator acknowledges that the logos, trademarks, trade names, and any other distinctive signs of the ICF and the Local Federation are the exclusive property of their respective owners.
Any use, reproduction, modification, or representation of the ICF and/or Local Federation logo by the Creator, in any form and for any purpose, is strictly prohibited without the prior explicit written consent of the ICF.
Any unauthorized use constitutes an infringement of intellectual and industrial property rights and may result in the immediate revocation of permission and further legal action.
8. Data Protection
Processing of personal data shall comply with Regulation (EU) 2016/679 (GDPR).
Photography and videography for documenting and promoting the Event constitute a legitimate interest of the ICF pursuant to Article 6(1)(f) GDPR.
9. Obligations of the Creator
The Creator shall comply with all safety, access, and organizational rules in accordance with the instructions of the Organizer and shall not interfere with athletes, officials, animals, or spectators.
10. Liability
The ICF, the Event, and the Local Federation shall not be liable for loss, theft, or damage to the Creator’s equipment or Material, except in cases of willful misconduct or gross negligence.
11. Governing Law and Jurisdiction
These Terms shall be governed by the law of the country in which the Event is held.
Any disputes shall be subject to the exclusive jurisdiction of the competent courts of that country.
12. Acceptance
By submitting a request and participating in the Event, the Creator acknowledges and accepts these Terms.
